Environmental Assessment

Environmental Site Assessments (ESAs) began in the 1970s as a result of the Love Canal environmental disaster in New York. These assessments were similar to current Phase I ESAs and were used to evaluate the risks of owning commercial properties that may have used, stored, or disposed of hazardous substances or toxic chemicals. 

There are three phases of ESAs:

  • Phase 1: A historical review, on-site inspections, and interviews.
  • Phase 2: A comprehensive investigation to assess contamination, which may include collecting samples, subsurface site investigations, and geophysical surveys.
  • Phase 3: The development of an action plan for remediation, which may include a detailed report that outlines the steps taken to clean up the site and plans for future investigations.

A Phase I Environmental Site Assessment (ESA) is a crucial risk management tool conducted during real estate property transactions. Its purpose is to obtain detailed information and develop a professional opinion about the environmental condition of the property. Let’s delve into the specifics:

  1. Historical Review:

  • Investigate the property’s usage history back to its first developed use.
  • Research available historical records, digital archives, aerial photography, maps to understand previous use, property development usage and any related environmental negative uses and impacts.

 

2. Agency Record Review:

  • Scrutinize agency records for indications of past or current use or release of possible contaminants.
  • During this step most environmental concerns that may affect the value of the property are identified.

3. Site Visit:

  • Conduct a visual inspection of the site to assess evidence of released contaminants.
  • Search for any hazardous products that could be related to the current or historial contamination on the site.

4. Interviews:

  • Engage with individuals knowledgeable about the property’s current and past use.
  • Gather testimonial records of information of potential negative environmental conditions in the property.

The Phase I ESA aims to assess historical and current property uses, including adjoining properties, to determine the presence of potential threats to environment or human health.
